1. Agreement

By accessing or using fortriss.ca (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Eligibility & Accounts

  • You must be at least 18 years old.
  • You are responsible for safeguarding login credentials.
  • Notify us immediately of any unauthorized access or use.

3. Acceptable Use

You may not:

  • Break laws or infringe intellectual property.
  • Upload harmful code or disrupt the Service.
  • Misrepresent your identity or affiliation.
  • Use the Service to transmit unlawful, offensive, or unsafe content.

We may suspend or terminate accounts for violations.

  • By submitting content, you grant Fortriss a non-exclusive, royalty-free license to use it for operating the Service.
  • You confirm you have the rights to your content and that it does not infringe others’ rights.
  • We may remove content that violates these Terms.

6. Privacy

Use of the Service is subject to our Privacy Policy.

7. Data Handling

We handle personal data in accordance with our Privacy Policy. This includes:

  • Collecting only information needed to provide and improve the Service.
  • Storing data on secure servers with reasonable safeguards.
  • Sharing data only with trusted service providers under confidentiality obligations.
  • Complying with applicable Canadian, U.S., and EU data protection laws.

By using the Service, you consent to this handling of your data.

We are not responsible for third-party websites linked from the Service. Use them at your own risk.

9. Purchases & Billing

  • Fees will be disclosed before purchase.
  • Payments are processed through third-party providers.
  • Except as required by law, fees are non-refundable.

10. Disclaimers

  • The Service is provided “as is” without warranties of any kind.
  • We do not guarantee uninterrupted, error-free operation.

11. Limitation of Liability

  • To the fullest extent allowed by law, Fortriss Safety Solutions Inc. is not liable for indirect, incidental, or consequential damages.
  • Maximum liability is the greater of CAD $100 or amounts paid to us in the last 3 months.

12. Indemnification

You agree to indemnify and hold harmless Fortriss Safety Solutions Inc. against claims, damages, or losses resulting from your use of the Service or breach of these Terms.

13. Arbitration and Mediation

  • Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be submitted to mediation in Spruce Grove, Alberta.
  • If mediation is unsuccessful, the matter will be resolved by binding arbitration in Spruce Grove, Alberta in accordance with the Arbitration Act, 1991 (Alberta).
  • Each party will bear its own costs unless otherwise determined by the arbitrator.
  • Judgments on the award may be entered in any court with jurisdiction.

14. Termination

We may suspend or terminate your access if you breach these Terms.
Certain provisions (IP, liability limits, indemnity, governing law, arbitration) survive termination.

15. Governing Law

These Terms are governed by the laws of Alberta, Canada, without regard to conflict-of-law rules. Venue for mediation and arbitration is Spruce Grove, Alberta.

16. Changes

We may update these Terms. Material changes will be notified by site notice or email. Continued use constitutes acceptance.

18. Entire Agreement

These Terms and referenced policies are the complete agreement between you and Fortriss Safety Solutions Inc.

19. Severability; Waiver

  • If any provision is held unenforceable, it will be modified to reflect the parties’ intent or severed where modification is not possible.
  • The remainder stays in effect.
  • Our failure to enforce a provision is not a waiver.

20. Assignment

  • You may not assign these Terms without our prior written consent.
  • We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
